New TM Classification Launching 1 Jan 2024

A new version of the International Classification of Goods and Services for the Purposes of the Registration of Marks (“Nice Classification”) is due to enter into force on 1 January 2024. It brings subtle changes to the world of Trade Mark Classification.
The Nice Classification is a global system that sorts all types of products and services into 45 separate classes – 34 for goods and 10 for services. Such classes assist with the administration of trade mark applications by grouping similar products/services together. Approximately 150 trade mark offices around the world use the Nice Classification system. This is the twelfth edition of the Nice Classification and is the result of the ongoing review of how technology develops, and new products and services are created over time. New editions are now set to be issued every five years.
Whilst this change does not require any action by existing trade mark owners, it is a good opportunity to review present protection and consider whether it is sufficient to protect your business as you enter into a new year. Companies regularly pivot their offering, requiring a trade mark portfolio to be a living collection rather than a single asset acquisition.
