How the European Patent Office Treats Added Subject Matter: Disclaimers
The European Patent Office's Board of Appeal upheld the revocation of Regeneron Pharmaceuticals Inc.'s patent. Nicholas Acham, a Senior Patent Attorney at Stratagem, provides a technical review of the Appeal, explaining the EPO's decision that the inclusion of a disclaimer during amendment of the claims added new, unpermissible subject matter that was not disclosed in the original application, violating European Patent Convention rules. Regeneron's appeal, which included multiple requests, was dismissed, reinforcing the EPO's stringent policy against amendments that extend beyond the original patent content.
